The legal framework for addressing gang conflicts is primarily codified in Straffeloven § 81 a, which allows for sentence enhancement when an offence is committed as part of an ongoing gang conflict or with the intention of provoking one.
The provision applies to serious criminal offences where the act has a demonstrable connection to gang-related conflict. Common examples include weapons possession, violence, threats, and other crimes committed as part of the power struggle between organized criminal groups. The prosecution must prove both that a gang conflict existed at the time of the offence and that the criminal act was committed in connection with this conflict. Courts assess these elements based on concrete evidence in each case, including intelligence reports, witness statements, and patterns of criminal activity.
In practice, police and prosecution authorities rely on ongoing monitoring of known gang groupings to establish the existence of a conflict. Law enforcement maintains databases tracking incidents, territorial disputes, and violent confrontations between rival groups.
