Definition

Bank robbery is a federal crime defined under 18 U.S.C. § 2113, which criminalizes taking or attempting to take money or other property from a bank, credit union, or savings and loan association by force and violence, intimidation, or extortion. The statute protects federally insured financial institutions and covers a range of conduct beyond the stereotypical armed holdup, including threats that compel employees or customers to surrender funds without physical violence.

The federal law distinguishes between several related offenses with varying penalties. Simple bank robbery carries up to 20 years imprisonment, while robbery committed through assault or putting lives in jeopardy increases the maximum to 25 years. If a defendant kills someone during the commission of a bank robbery or if death results from the crime, they face a potential death sentence or life imprisonment. The statute also criminalizes bank burglary, entering a bank with intent to commit larceny, and simple theft from financial institutions, each carrying lesser penalties than robbery.

Historically, bank robbery became a federal offense during the Great Depression era when a wave of robberies threatened public confidence in the banking system. Notable criminals like John Dillinger, Bonnie and Clyde, and the Barker-Karpis gang elevated bank robbery to national prominence in the 1930s, prompting Congress to expand federal jurisdiction over these crimes. The Federal Bureau of Investigation gained authority to investigate bank robberies, establishing it as a cornerstone of federal law enforcement.

In true crime discourse, bank robbery encompasses any forcible taking from a financial institution, though the legal definition requires specific elements including intimidation or violence. The modern crime remains subject to federal prosecution regardless of the amount stolen, and jurisdiction extends to any institution whose deposits are insured by federal agencies. This broad federal reach means that most bank robberies in the United States are prosecuted in federal rather than state courts, typically resulting in longer sentences than comparable state robbery charges.
