A police investigation is the formal process by which law enforcement agencies examine suspected criminal activity, collect and preserve evidence, interview witnesses and suspects, and build a case for potential prosecution. In the United States federal system, this investigative authority is granted to agencies such as the Federal Bureau of Investigation (FBI), whose special agents are empowered to detect and prosecute crimes against the United States.
The investigation typically begins when law enforcement becomes aware of a possible crime through reports, complaints, or independent observation. Investigators employ various methods including physical evidence collection, witness interviews, surveillance, forensic analysis, and documentation of the crime scene. Throughout this process, investigators must adhere to constitutional protections, particularly Fourth Amendment restrictions on searches and seizures and Fifth Amendment rights against self-incrimination.
The scope and duration of investigations vary significantly depending on the complexity of the alleged crime. Simple cases may be resolved within days, while complex white-collar crimes, organized crime cases, or serial offenses may require months or years of investigation. Federal investigations often involve coordination between multiple agencies and may cross state or international boundaries.
The investigative phase is legally distinct from prosecution. While prosecutors may provide guidance during investigations, the investigative work focuses on fact-finding and evidence gathering rather than legal adjudication.
